SOME THOUGHTS ON JOINT SESSIONS

When I began to mediate cases as an advocate for clients, we almost always had a joint session to begin. Over the years, use of this joint opening session has declined. Now as a mediator, counsel usually tell me they do not want a joint session because it will get in the way of a resolution, or is a waste of time.
